Terms and Conditions of Use of the Team Pulse website and mobile application

The registration and use of the website, as well as of the Team Pulse mobile application requires the full acceptance of these conditions

1. Definition

"Application" means, in this Agreement, the website, the mobile application of Team Pulse named Team Pulse and the services provided through them.
"Publisher" means, in this Agreement, the manager of the Application.
"User" means, in this contract, any natural or legal person wishing to access the application.


2. Subject

The purpose of these « general terms of use » is to provide a legal framework for the use of the Application.
This contract is concluded between the Publisher and the User.
The general conditions of use must be accepted by any User. Access to the Application requires acceptance of these conditions.


3. Access to services

Any User with access to the Internet can access the Application free of charge and from anywhere. The costs incurred by the User to access it (internet connection, computer equipment, etc.) are not borne by the Publisher.
The Application may be interrupted or suspended by the Publisher, in particular during maintenance, without the need for prior notice or justification.
Team Pulse reserves the possibility to propose some paid services.
Team Pulse reserves the right to modify, at any time, the content or the nature of the Services.


4. Responsibility of the User

The User is responsible for the risks related to the use of his login name and password.
The User's password must remain secret. In case of disclosure of the password, the Publisher declines all responsibility.
The User assumes full responsibility for the use he or she makes of the information and content present on the Application.
Any use of the service by the User resulting directly or indirectly in damage must be subject to compensation for the benefit of the Application.
Members undertake to speak respectfully of others, of the law and to accept that these publications be moderated or refused by the Publisher, without obligation of justification.


5. Responsibility of the Publisher

The Publisher cannot be held responsible for any server or network malfunction.
Similarly, the Application cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.
The Application undertakes to implement all necessary means to guarantee the security and confidentiality of the data. However, it does not provide a guarantee of total safety.
The Publisher reserves the right not to guarantee the reliability of the sources, although the information disseminated on the Application is deemed reliable.


6. Intellectual Property

The contents of the Application (logos, texts, graphical elements, photos, etc.) are protected by copyright under the Intellectual Property Code.
Any copy, reproduction, representation, adaptation, alteration, modification, unauthorized diffusion, integral or partial, of the Services and/or of the content of the application, whether it is the content belonging to Team Pulse or to a third party, is illicit and may engage the criminal and civil liability of the offending User.
The various contents can be used by users for private purposes. Any lucrative or commercial use is prohibited.
The User is entirely responsible for any content he puts online and undertakes not to harm a third party.
The User commits himself to defend Team Pulse and to take in charge and/or indemnify Team Pulse for any prejudice which could result from any action or claim of a third party, concerning the communications put online by the User.
The Application Publisher reserves the right to freely moderate or delete at any time the content put online by users, without justification.


7. Personal data

The User is required to provide personal information in order to register on the Application.
Team Pulse commits itself to respect the confidentiality of the personal information transmitted.
Personal information are processed by Team Pulse for the purposes of User profile management, marketing and statistical studies, Services quality follow-up, customer relationship management and commercial prospecting in order to provide Users with the most adapted Services.
The User's e-mail address may be used by the Application to manage the account.
Team Pulse guarantees the respect of the user's private life, in accordance with the law n°78-17 of January 6th, 1978 relative to computing, files and liberties.
By virtue of articles 39 and 40 of the law dated 6 January 1978, the User has a right of access, rectification, deletion and opposition relating to personal information concerning him/her. To exercise this right, the User must send a letter to the following address: 81 Avenue de la route bleue - 42210 Montrond-les-bains.


8. Hypertext links

The domains to which the hypertext links present on the Application lead do not engage the responsibility of the Application Publisher, which has no control over these links.


9. Evolution of the general conditions of use

The Application reserves the right to modify the clauses of these general conditions of use at any time and without justification.


10. Duration of the contract

The duration of this contract is indefinite. The contract takes effect with regard to the User from the beginning of the use of the service.


11. Applicable law and jurisdiction

The present Terms and Conditions of Use are subject to French law.
In the event of a dispute not amicably resolved between the User and the Publisher, the French courts have jurisdiction to settle the dispute. However, the Parties undertake to seek an amicable solution before any legal action is taken.
